These Terms of Service govern the use of boogdazeg.shop and purchases made through the store.

Mandatory consumer rights under German and European Union law remain unaffected.

Scope

These Terms apply to contracts between boogdazeg.shop and customers purchasing through this website.

A consumer is a natural person entering into a transaction predominantly for purposes outside that person’s trade, business, or profession.

Any customer terms that conflict with these Terms apply only if expressly accepted by us.

Website Information

Product listings are invitations to submit an order and do not by themselves constitute a binding offer.

Before submitting an order, you can review the selected items, quantities, price, delivery details, and other information and correct input errors using the checkout controls.

The languages available for concluding the contract are those offered during checkout. These Terms are provided in English.

Formation of Contract

By selecting the final order button, you submit a binding offer to purchase the products in your cart.

An automated order-receipt message confirms receipt of the order but does not necessarily constitute acceptance unless it expressly states otherwise. The contract is concluded when we expressly accept the order, dispatch the goods, or otherwise clearly confirm acceptance.

We may decline an order before acceptance for legitimate reasons, including product unavailability, obvious pricing errors, failed payment authorisation, suspected fraud, delivery restrictions, or legal prohibitions. Payments collected for an unaccepted order will be reimbursed.

Contract Records

Order information and these Terms may be stored electronically. Customers should save or print the order confirmation and the version of the Terms applicable when ordering.

Registered customers may be able to view certain order information through their accounts, but continuous account availability is not guaranteed.

Products

Product features and specifications are described on the product page. Minor variations that do not affect conformity may occur because of screen display, photography, materials, or production processes.

Any material product substitution requires the customer’s agreement unless the substitution is legally permissible and does not disadvantage the customer.

Prices and Taxes

Prices displayed for consumers include applicable VAT where required, unless the checkout clearly and lawfully states otherwise.

The final total is shown before the order is submitted. Standard shipping is free under the Shipping Policy. Any legally applicable additional charge will be disclosed before the customer places the order.

Obvious pricing or calculation errors may be corrected before contract acceptance. After a contract has been formed, applicable legal rules govern any correction.

Payment

Available payment methods are displayed at checkout. Payment may be processed by an independent payment provider.

The customer must provide accurate payment information and be authorised to use the selected method. If payment is declined or reversed without legal justification, we may suspend performance and exercise rights available under applicable law.

Delivery

Delivery is governed by the Shipping Policy. The estimated delivery time for standard shipping is 15–20 days, subject to the qualifications stated there.

Where German consumer law applies and no different period has been validly agreed, statutory delivery protections remain unaffected.

Retention of Title

Goods remain our property until the purchase price has been paid in full, to the extent permitted by law.

Right of Withdrawal

Consumers may have a statutory 14-day right of withdrawal. Full instructions, consequences, exceptions, and the model form appear in the Return and Refund Policy.

Conformity and Warranty

Statutory rights relating to defective and non-conforming goods remain unaffected.

Customers should contact info@boogdazeg.shop and provide the order number and a description of the issue. Requesting photographs or supporting information does not unlawfully limit statutory rights.

No manufacturer’s or commercial guarantee applies unless expressly stated for the relevant product.

Customer Accounts

Customers must provide accurate information and keep login credentials confidential. You are responsible for activity performed through your account to the extent permitted by law.

Notify info@boogdazeg.shop promptly if you suspect unauthorised access.

We may restrict an account where reasonably necessary to protect customers, prevent fraud, comply with law, or address material misuse.

Acceptable Use

You must not:

• use the website for unlawful or fraudulent purposes;
• interfere with website security or operation;
• introduce malware or harmful code;
• attempt unauthorised access to systems or accounts;
• scrape or extract website data through abusive automated means;
• impersonate another person;

Liability

Force Majeure

We are not responsible for delay caused by events beyond reasonable control to the extent recognised by law, including severe weather, natural disasters, war, governmental restrictions, major transport disruption, industrial action, or infrastructure failure.

We will take reasonable steps to reduce the effects and inform affected customers where appropriate. Mandatory cancellation, refund, and delivery rights remain unaffected.

Amendments

The Terms applying to an order are generally those in effect when the order is placed.

We may update these Terms prospectively for legal, technical, or operational reasons. Changes do not retroactively alter an existing contract without a valid legal basis and any required customer agreement.

Severability

If a provision is invalid or unenforceable, the remaining provisions continue to apply. Mandatory law replaces the invalid provision where legally required. This clause does not permit an invalid term to be rewritten to the customer’s disadvantage.

Governing Law

German law applies, excluding the United Nations Convention on Contracts for the International Sale of Goods.

For consumers residing outside Germany, this choice does not deprive them of mandatory protections provided by the law of their habitual residence where those protections apply.

Statutory rules concerning competent courts and consumer jurisdiction remain unaffected.
